Fatal Pedestrian Crashes in New Mexico
Even though pedestrians are entitled to use the road the same as everyone else, a significant number of automobiles continue to kill pedestrians. Despite a countrywide decline in passenger car deaths, pedestrian fatalities continue to rise year after year.
According to the National Highway Traffic Safety Administration, pedestrians are 1.5 times more likely than drivers to die in an accident. In the case of an accident, pedestrians have considerably less protection, rendering them more vulnerable to suffering life-threatening injuries. In 2017, New Mexico had the highest rate of walking-related fatalities in the nation.
Wrongful death cases in New Mexico are designed to reimburse surviving family members when another party's negligence causes a loved one's death, but achieving such compensation is frequently easier said than done. The death of a victim does not absolve the at-fault party of responsibility, but their insurance companies will frequently try to transfer blame for a fatal collision.
Still, the responsible individual should compensate the deceased's family members following a fatal vehicle accident to assist with accident-related costs. This can only be done by working with a New Mexico personal injury lawyer that has years of expertise assisting victims with wrongful death cases.
