The number of fatal car accidents has increased as a result of our culture's increasing reliance on technology. In New Mexico, where most drivers have access to electronic devices like cell phones and smartwatches, driving distractions are more common than ever. Distracted driving claimed the lives of 3,142 people overall in 2020. Accidents involving distracted driving resulted in 424,000 injuries and more than 3,100 fatalities nationwide in 2019. If a distracted driver caused your crash and you were hurt, you might be entitled to compensation.
The majority of preventable auto accidents are brought on by the carelessness of other drivers. In order to obtain compensation from the at-fault party's insurance company in a lawsuit involving injuries received in an automobile accident, you must demonstrate that the other driver was to blame for your accident and your injuries. The New Mexico legal system is more traditional and fault-based when it comes to legal claims concerning traffic accidents. This implies that it could be difficult to establish who is responsible for a car accident if you do not strictly adhere to the necessary legal procedure. In order to prevail in a personal injury case, you must be able to show certain legal requirements, such as the fact that the negligent party owed you a duty of care and disregarded that obligation.
Navigating the claims process can be challenging, particularly if you are still recovering from a major car accident. You might be worried about how you will pay your bills while you take time off to recover if a careless motorist damaged you or a loved one in an accident. You could file a personal injury lawsuit claim against the at-fault driver's insurance policy if you want to acquire the money you require and be able to fully heal. You have three years in New Mexico from the accident to submit a claim. You face the danger of losing your opportunity to get the payment you are entitled to for your damages if you miss that deadline.
