Driving negligently and breaking the law on the road is illegal in New Mexico. Unfortunately, some drivers decide to operate their vehicles recklessly, endangering both themselves and other road users. Every day, reckless drivers cause accidents in New Mexico, and they are to blame for one-third of all fatalities on the roads nationwide. If a careless motorist damaged you unfairly and you want to recover lost compensation, talk to an attorney to start building your case.
The majority of avoidable car accidents are caused by other drivers’ negligence. In a case involving injuries sustained in an auto accident, you must demonstrate that the other motorist was at fault for your accident and your injuries in order to receive compensation from the defendant’s insurance company. When it comes to litigation claims involving traffic accidents, the judicial system in New Mexico is more conventional and fault-based. This suggests that if you do not precisely follow the proper legal procedure, it may be challenging to determine who is at fault for an automobile accident. You must be able to demonstrate specific legal requirements, such as the fact that the negligent party owed you a duty of care and disregarded that responsibility, in order to succeed in a personal injury case.
It can be difficult to navigate the claims procedure, especially if you are still healing after a serious car accident. You might be concerned about how you will pay your bills while you take time off to recover if a negligent motorist caused an accident that injured you or a loved one. If you want to get the money you need and be able to fully recover, you could file a personal injury lawsuit claim against the at-fault driver’s insurance policy. In New Mexico, you have three years from the accident to file a claim. If you miss that date, you risk losing your chance to receive the compensation you are entitled to for your damages.
