The Most Common Causes of New Mexico Auto Accidents

Auto accidents happen due to a number of factors, such as driver error and poor choices behind the wheel, with some factors being easier to prove.

Driver Negligence

A driver is usually seen as negligent when they do something that puts themselves and others at risk of being seriously injured. Some of the most common forms of negligence involved in auto accidents claims include:

  • Distracted driving
  • Hazardous roadways
  • Failure to yield
  • Unsafe lane change
  • Improper turns
  • Driver exhaustion
  • Speeding
  • Reckless driving
  • Drunk drivers
  • Tailgating
  • Inclement weather

Rember that New Mexico implements a model of pure comparative fault, meaning that someone can recover damages from another involved party regardless if they contributed to the crash. The amount won at trial may be reduced by a percentage corresponding to the party’s negligence.
