How to File a Wrongful Death Claim in Los Lunas
In New Mexico, a wrongful death claim is generally filed by a personal representative of the deceased person’s estate. This representative acts on behalf of surviving family members, which may include a spouse, children, or parents. Families affected by a fatal crash should speak with an Albuquerque wrongful death lawyer to understand what compensation may be available to them.
A thorough investigation is essential to building a strong claim. Police reports, crash reconstruction findings, witness statements, and medical documentation can help establish fault and demonstrate the full impact of the loss. An experienced New Mexico car accident attorney can handle this investigation on your behalf while you focus on recovery and healing.
In New Mexico, fatal pedestrian crashes remain a serious concern. Preliminary 2024 data from the Governors Highway Safety Association show about 94 people were killed walking on or near roads, down from around 108 in 2023, but the state still has the highest per-capita pedestrian fatality rate in the U.S. at roughly 4.4 deaths per 100,000 residents.
More than half of these deaths occur in Bernalillo County, including Albuquerque.
Families may be able to recover compensation for medical expenses incurred before death, funeral and burial costs, lost future income, and loss of companionship. Each case depends on the specific circumstances surrounding the crash.
New Mexico law also imposes a statute of limitations, meaning claims must be filed within a specific timeframe. Failing to act within that period can prevent families from seeking compensation.
Consulting a personal injury lawyer in Los Lunas can help ensure that the proper steps are taken, evidence is preserved, and insurance companies are handled appropriately. Legal guidance can provide clarity and support while families focus on grieving and healing.
