How Long Do Families Have to File a Wrongful Death Lawsuit in Albuquerque, NM?
In New Mexico, a personal representative of the estate generally has three years from the date of death to file a wrongful death lawsuit under the state’s statute of limitations. That deadline is separate from any criminal investigation into the crash, which can sometimes continue for months without affecting the civil filing window.
Evidence relevant to a case, such as nearby surveillance footage or street lighting data, typically becomes harder to obtain well before the three-year deadline arrives, which makes early action important even though the legal filing window itself is longer.
A wrongful death claim in New Mexico is brought on behalf of statutory beneficiaries, typically a spouse, children, or other close family members, and is separate from a survival action, which compensates for the pain and losses the victim experienced between the time of injury and death.
Because New Mexico follows a pure comparative negligence rule, a family can still recover compensation even if the victim is found partially at fault, with the amount reduced by that share of fault.
Given how quickly time-sensitive evidence can disappear, an Albuquerque wrongful death lawyer can begin working on a case well before the three-year deadline approaches, gathering things like roadway lighting data, vehicle event recorder information, and witness statements while they’re still available.
