What Compensation Can Families Receive After a Fatal Pedestrian Accident in Roswell, NM?
Families can recover compensation for funeral expenses, lost wages, pain and suffering, and more after a Roswell fatal pedestrian crash in New Mexico. These costs add up quickly and often arrive before families have had time to process what happened. A wrongful death claim can include these expenses as part of the damages sought.
Medical bills incurred between the crash and the victim’s death are also recoverable. Emergency treatment, ambulance transport, and any hospital care provided before death count as compensable losses. Families should gather and preserve all billing records from the date of the accident forward.
New Mexico wrongful death law allows families to seek damages for the income the victim would have earned over their lifetime. This includes wages, benefits, and other financial contributions the deceased regularly provided. The calculation accounts for the victim’s age, occupation, and expected working years.
Loss of companionship is a recognized category of damages under New Mexico law. Spouses, children, and parents can seek compensation for the guidance, care, and relationship they have lost. These losses are real and documented through personal testimony and family records.
If the victim experienced pain or was conscious before death, surviving family members can seek compensation for that suffering. New Mexico law permits these damages when evidence supports that the victim was aware of their injuries. Medical records from the scene and hospital are key to establishing this.
Insurance companies often challenge wrongful death claims involving pedestrians. Insurers may dispute liability, argue the pedestrian was at fault, or offer settlements far below what families are owed. Families who accept early offers without legal guidance often recover less than they are entitled to.
A New Mexico wrongful death lawyer can handle communications with insurance companies on the family’s behalf. An attorney can gather evidence, identify all liable parties, and build a complete picture of the family’s losses. Legal representation helps ensure no category of damages is overlooked or undervalued.
