Car Accidents in New Mexico
Being hurt in a car crash can change your life forever. Regrettably, there are thousands of cases where people are injured as a result of automobile accidents. Victims are often left with serious injuries that affect every aspect of their lives. Unfortunately, treating injuries can be incredibly costly. For this reason, injured parties are encouraged to file personal injury lawsuits against those who are responsible.
In New Mexico, the state follows a “pure comparative negligence” system. This means that in a lawsuit related to a car accident, you can still receive compensation, but the amount you’re awarded will be adjusted based on your proportion of fault.
For example, if a jury determines that your total damages, including injuries, pain and suffering, and other losses, amount to $100,000. However, the jury also finds you to be 10 percent responsible for the accident. In this scenario, your total damages of $100,000 are reduced by 10 percent, which is $10,000, resulting in a final award of $90,000.
Even if you are assigned more fault than any other party involved, you can still recover damages. However, it’s important to note that you also may be responsible for covering the financial losses of other parties in the accident. This makes it important for you to seek legal representation from an Albuquerque car accident lawyer right away.
