Car Accidents in New Mexico
Being hurt as a result of a motor vehicle accident can impact your life in a variety of ways. Quite often, people who are harmed by accidents have to go through extensive medical treatment.
There are a number of common causes of car accidents in New Mexico. One is driver error, such as driving too fast for conditions, failing to yield the right-of-way, or making an improper turn. Another common cause is weather-related factors, such as slick roads due to rain or snow. Other causes include mechanical problems with the vehicle, such as brake failure, and distracted driving, such as texting while behind the wheel.
Unfortunately, acts of negligence continue to cause harm to innocent people every single day in our state. Some of the most common injuries suffered during New Mexico car accidents include lacerations, broken bones, and whiplash. More serious injuries, such as traumatic brain injury or spinal cord damage, can also occur.
If you’ve been hurt as a result of a vehicle accident, a car accident lawyer in Albuquerque can help you better understand your rights and responsibilities. Depending on the circumstances surrounding your crash, you may be able to file a legal claim to recover compensation.
In New Mexico, if you are involved in a car accident, the state follows the rule of pure comparative negligence. This means that if you are found to share the fault for the accident, the amount of compensation you can obtain from the defendant will be reduced by the percentage that you are at fault. For example, if you are awarded $10,000 in damages but are found to be 20% at fault, you would only receive $8,000.
