The majority of car accidents in New Mexico are caused by some form of driver error. When drivers engage in reckless behaviors behind the wheel, they can be held liable for any resulting injuries and damages. Driver distraction continues to be a serious issue in New Mexico. In 2021, there were 195 deaths reported in the state caused by driver distraction. Statistics show that almost 41 percent of deadly collisions in New Mexico involve a distracted driver, and this is much higher than the national average. Driver distraction was a factor in nearly 21.5 percent of injury crashes and 8.3 percent of deadly collisions in the state in 2018.
If you want to successfully pursue a personal injury claim, you need to be able to establish that the at-fault party acted in a negligent manner. This can be hard to do on your own, but a lawyer will know exactly what to do in order to determine who is liable for your accident. To establish negligence, you need to show that the at-fault party had a duty of care and that they breached that duty by engaging in reckless behavior. This breach has to be shown to have directly caused your injuries. Your lawyer will be able to investigate your accident and gather the relevant information needed to show who is responsible.
The point of pursuing a personal injury claim is to recover compensation for your injuries and other damages after a car accident. You may be able to recover economic and non-economic damages. Economic damages are more tangible and involve things like hospital bills and other out-of-pocket expenses. Non-economic damages are less tangible and can include things like pain and suffering. These are harder to quantify and can be challenging to get without the help of an experienced personal injury lawyer. If you want to find out what damages are available in your case, you need to contact a trusted attorney as soon as you can.
