Santa Fe, NM (July 3, 2026) – Two men were hurt, one critically, after an ATV crash in a field near Herrera Drive and Paseo Del Sol on Thursday, July 2.
The Santa Fe Police were dispatched to the dirt trail area following the report. Both men were found hurt when police arrived and were taken to a hospital for treatment.
Police believe alcohol was a factor in the crash. The DWI Unit drafted and served a search warrant as part of the ongoing investigation.

Can ATV Passengers Seek Compensation After a Crash in Santa Fe, NM?
Yes, a passenger hurt while riding along on an ATV can generally seek compensation from the driver if that driver’s impairment or recklessness caused the crash.
Passengers on ATVs face many of the same injury risks as the operator, including fractures, head trauma, or internal injuries. If alcohol is suspected, a passenger’s claim may be strengthened by the same evidence gathered in the criminal investigation, including results from the search warrant served by the DWI Unit.
New Mexico allows an injured passenger to bring a civil claim against the driver independent of any criminal DWI proceedings, and a dram shop claim could also come into play if the driver was served alcohol irresponsibly before the crash. A Santa Fe personal injury lawyer can help a passenger track both the criminal case and any dram shop angle while building a claim against the driver responsible for the ATV.
