What Is the Statute of Limitations to File a Car Accident Claim in New Mexico?
In New Mexico, injured people generally have three years from the date of a car accident to file a personal injury lawsuit. Missing this deadline typically means losing the right to seek compensation through the courts.
Three years may seem like a long time, but acting early in the process offers significant advantages. Evidence from the scene, like skid marks, vehicle positions, and road conditions, disappears quickly. Starting the legal process early helps preserve these critical pieces of evidence and gives an attorney the time needed to build a thorough case.
New Mexico follows a pure comparative fault rule, which sets it apart from many other states. Under this system, an injured person can recover compensation even if they were partially at fault for the crash. However, the total amount of compensation they receive is reduced by their assigned percentage of fault.
In serious crashes, injuries tend to be severe and long-lasting. Broken bones, spinal injuries, traumatic brain injuries, and internal trauma are common outcomes in these types of accidents. Some injuries require multiple surgeries, extended rehabilitation, and long-term care. The financial impact of these injuries can be significant, affecting a person’s ability to work and maintain their quality of life. Documenting all medical treatment from the beginning creates a clear record of how the crash affected the injured person over time.
An injured person in New Mexico may be eligible to seek compensation for medical expenses, lost wages, pain and suffering, and long-term care costs. A car accident attorney can review the available evidence and explain what types of compensation may apply based on the specific facts of the case.
