Can Families Recover Compensation After a Fatal Hit-and-Run Crash in Carlsbad, NM?
Yes, families may still recover compensation after a fatal hit-and-run in Carlsbad, even if police have not identified the driver. New Mexico law may allow claims through uninsured motorist coverage. Other options may also be available depending on the facts of the case.
One option may involve a claim through your loved one’s uninsured motorist coverage. This coverage may apply to wrongful death damages when the driver is unknown. It may help cover funeral costs, lost income, and other losses.
Under New Mexico’s Wrongful Death Act, a personal representative of the estate must file the claim. That person may be a surviving spouse, parent, or adult child. If no one has been named, a court can appoint someone for the family.
Your family has three years from the date of death to file a wrongful death case. That may sound like enough time, but evidence can disappear quickly. Camera footage, witness memories, and road marks can fade within days or weeks.
In Carlsbad, Standpipe Road runs through residential and rural areas with limited lighting in some sections. Roads like U.S. Highway 285 and National Parks Highway also carry fast traffic through low-visibility areas. These conditions can raise the risk of serious crashes, especially late at night.
If police later find the driver, your family may pursue a direct claim against that person. In New Mexico, leaving the scene of a fatal crash is a felony. A criminal conviction may also support a civil wrongful death case.
Before you sign anything from an insurance company, you should ask a wrongful death attorney to review your options. A lawyer can identify every possible source of recovery and help protect key deadlines. Early guidance can shape how the entire case moves forward.
