Who Can File a Wrongful Death Claim in Clovis, NM?
In New Mexico, the personal representative of the deceased person’s estate files a wrongful death claim. A court appoints this person, or the will names them. The claim is filed for the spouse, children, or other eligible family members.
If there is no spouse, the deceased person’s children may receive compensation through the claim. When there are no children, parents or other dependents may qualify. New Mexico law decides who qualifies based on the family structure.
Once the right person files, the claim may seek compensation for funeral costs, lost future income, and loss of companionship. Medical bills from treatment before death may also count. These damages help cover the financial and personal losses the family now faces.
In Clovis, fatal crashes on two-lane highways like State Route 245, US-60, and US-70 can leave families facing sudden loss. High speeds and narrow shoulders on rural roads can make wrecks more serious. Knowing who can file is the first step toward holding the at-fault driver accountable.
After a fatal crash, families should know New Mexico gives them three years from the date of death to file a wrongful death claim. If they miss that deadline, it can end their right to seek compensation. Starting early helps preserve police reports, medical records, and witness statements.
Because the claim goes through the estate, the process involves more steps than a standard injury case. The representative must be officially appointed before the claim can move forward. A wrongful death lawyer can help protect the claim and guide the family through each step.
