How Do Insurance Claims Work After a Crash in Curry County, NM?
In New Mexico, all drivers are required to carry minimum liability insurance, currently $25,000 per person and $50,000 per accident for bodily injury. After a crash, the claims process typically begins with each driver notifying their own insurer.
From there, adjusters from both sides begin gathering information, reviewing the police report, and assessing vehicle damage and injuries. What many people don’t realize is that insurance companies work to resolve claims efficiently from the moment they are notified. This is why it is important to seek legal guidance from a car accident lawyer before giving any early statement that could affect a claim.
New Mexico is an at-fault state, which means the driver responsible for causing the crash bears financial responsibility for the resulting injuries and damages. That sounds straightforward, but in practice it rarely is. When injuries are serious, insurers often dispute the extent of harm, question the necessity of certain treatments, or argue that pre-existing conditions are responsible for some of the reported symptoms.
Uninsured and underinsured motorist coverage becomes critically relevant when the at-fault driver carries minimum policy limits that fall far short of covering the actual costs involved. Air medical transport alone can generate bills in the tens of thousands of dollars, and that is before accounting for hospital stays, specialist care, rehabilitation, and lost income. In rural areas like Curry County, where some drivers carry only minimum coverage, gaps between policy limits and actual damages are not uncommon.
