Any person who relies financially on the decedent may submit a claim in some states. However, only the estate's personal representative is able to file a wrongful death claim in New Mexico. A judge may designate a person to act as the personal representative of someone who was wrongly killed and had no will to nominate a personal representative in the event of a wrongful death.

A wrongful death claim can be made on behalf of many possible parties, although it can only be initiated by a single personal representative. In wrongful death cases, there are many potential damages that can be awarded. The two primary types of damages are compensatory and punitive. While compensatory damages are meant to make up for the losses that the deceased person's passing caused for their loved ones, punitive damages are meant to punish the party who caused the deadly accident.
