Time Limits for Filing a Wrongful Death Claim in Santa Fe, NM
New Mexico law gives surviving family members three years from the date of death to file a Santa Fe wrongful death claim. This deadline applies in most cases and begins on the day the person passes away. Filing within this period helps preserve the right to pursue compensation through the court system.
Only the personal representative of the deceased’s estate can file a wrongful death claim in New Mexico. That person is named in a will or appointed by a court. Their legal standing directly affects when and how a claim moves forward.
Courts dismiss claims filed after the statute of limitations expires. Once dismissed, the right to seek compensation is typically lost. There are very few situations where a court will make an exception.
In some cases, the discovery rule may delay when the clock starts. This applies when the cause of death was not immediately known. An attorney can assess whether any exception applies to a specific situation.
When a government agency may be responsible, shorter deadlines apply. New Mexico requires a notice of claim to be filed within 90 days of the incident. Missing this notice period can eliminate the right to sue entirely.
Gathering medical records, crash reports, and witness statements takes time. Starting the process early preserves key evidence before it becomes unavailable. Delays in documentation can complicate filing even before the deadline arrives.
A Santa Fe wrongful death attorney tracks all applicable deadlines and handles procedural requirements on your behalf. Legal guidance helps prevent filing errors that could delay or dismiss a claim.
