Car Accidents in New Mexico
In 2021, over 450 people died as a result of traffic collisions in the state in New Mexico. Crashes left thousands of other people with significant injuries that demand medical care. We see countless people left with significant spinal cord injuries, traumatic brain injuries, and broken bones that require medical attention. Not only are injuries painful to deal with, but they are costly to treat as well. In some cases, injured parties are able to pursue legal action to recover compensation for medical expenses and more. The amount of compensation you are able to recover will depend on who is at fault for the crash.
In New Mexico, the courts use a pure comparative negligence system when determining how to award damages in a car accident case. This means that the judge reviewed the actions of both drivers involved in the crash and assigned a percentage of fault to each party. The court will then use this percentage to determine how much each party is responsible for paying in damages.
For example, if you are all involved in a crash where the other driver ran a red light and collided with your car, the court may find that the other driver is 80% at fault for the accident and you are 20% at fault because you were not paying attention to the traffic signal. This means that the other driver would be responsible for 80% of the damages and you would be responsible for 20% of the damages.
It’s important to note that even if you are found to be partially at fault for an accident, you may still be able to recover damages from the other party. However, your recovery will be reduced by your percentage of fault. A car accident lawyer in Albuquerque can help you secure the money you need and desire following your crash.
