In 2021, speeding contributed to 29% of all roadway fatalities, resulting in 12,330 deaths, or more than 33 fatalities per day on average. A total of 11,057 fatal motor vehicle accidents were caused by speeding. When drivers travel too fast for road conditions or exceed the posted speed limit, they are more likely to cause devastating car accidents.
Victims tend to worry that it may be impossible for them to get the money they need to cover their expenses and make up for lost wages due to missed work. New Mexico is a pure comparative fault state, and you are permitted to sue anyone who may have contributed to your injuries, regardless of your level of fault for an accident. Pure comparative fault does have some drawbacks. Your final compensation is decreased by the amount of negligence you are eligible for.
Consider this as an example. If a jury determined that you are 45% at fault and you are awarded a $100,000 award, your final award would be $45,000 less and you would still receive $55,000. This can make your case difficult to understand, and you should immediately retain legal counsel to launch a thorough investigation into the accident. You need to determine what caused the accident and gather all necessary evidence that the at-fault party is responsible for your damages.
You may be able to pursue compensation in a personal injury claim if you believe that another driver's negligence contributed to your injuries in a car accident.
