Across New Mexico and the entire United States, car accidents continue to be the leading cause of death and serious injury. The number of car accidents fatalities in the state have been a cause for concern for many years now. While New Mexico is home to some of the worst drivers in the country, Albuquerque has some of the worst drivers in the state. There were 19,034 reported car accidents in Bernalillo County in 2019 alone. That means a crash was reported almost every 27 minutes. The state has the unfortunate reputation of having a high rate of alcohol-related car accidents, and there were 675 crashes involving alcohol reported in Albuquerque alone that year.
The person responsible for a serious car accident will be held financially responsible for any resulting damages under New Mexico's fault laws. Negligence on the road comes with a significant cost in the state. It can be difficult to determine who is responsible for your injuries, especially if there are multiple drivers involved in your accident.
You have three times after the date of your accident to pursue a claim for compensation in New Mexico. This timeframe is known as the statute of limitations. However, there are many factors that can alter the time limit needed to file a claim. You should always consult with a personal injury lawyer to determine if there is anything impacting your ability to pursue a claim for compensation. The other driver could even argue that you share the blame for the accident. This can reduce your compensation under the state’s comparative fault laws. This can seem complicated to understand if you have little experience in the law.
