An ongoing investigation into the cause of the accident is in progress.
We would like to extend our deepest condolences to the family of the deceased victim at this time.
We all share the road with large trucks, as they transport all of the goods we rely on having access to our in local stores day to day. In the United States, there are 500,000 semi-truck accidents reported each year, which cause hundreds of thousands of injuries and more than 5,000 fatalities. About 1,400 of the 43,000 or more car accidents in New Mexico each year involve semi-trucks, and one out of every 30 semi-truck accidents results in fatal injuries.
In a wrongful death lawsuit, the at-fault party can be held responsible for their actions. Everyone has a responsibility to drive safely, and this is particularly true of truck drivers. When that duty of care is breached, and someone is harmed or killed as a result, the law allows you to seek compensation for that loss. When a person dies in a car wreck they did not cause, surviving family members have the right to file a wrongful death claim.
Any subsequent wrongful death action can be filed by the person chosen to serve as the decedent's personal representative. Depending on the situation, that representation can be a relative of the deceased, a lawyer, or a guardian appointed by the court. It can be useful to have an impartial party represent the deceased individual in the lawsuit when the survivors are at odds with one another or when there may be a dispute over who is entitled to any money recovered in the litigation.
