How Long Do Families Have to File a Wrongful Death Claim in Rio Rancho, NM?
In New Mexico, a wrongful death lawsuit generally must be filed within three years of the person’s death. If the claim is not filed before that deadline expires, surviving family members may lose the opportunity to pursue compensation through the courts. State law measures this three-year period from the date of death rather than the date of the underlying collision.
After a fatal crash, relatives face expenses related to medical treatment, funeral arrangements, and the loss of financial support. While each case is different, state laws establish these specific deadlines that apply to legal claims arising from a person’s death. Certain circumstances may affect how these deadlines are calculated, which is why timely legal guidance can be beneficial.
For families in Rio Rancho, it can be especially important to understand these deadlines after a fatal traffic crash on heavily traveled routes such as US 550. While three years may seem like a long time, to investigate a fatal collision, gather records, and identify all potentially responsible parties can take considerable time.
A Rio Rancho wrongful death lawyer can review the facts of a case, explain relevant filing requirements, and help preserve evidence before it becomes more difficult to obtain. Legal counsel may also identify insurance policies or other sources of recovery that could be available depending on the circumstances.
At Will Ferguson & Associates, we understand that uncertainty that families may face after a fatal accident in Rio Rancho or anywhere across New Mexico. We can review your case and discuss general legal options, explain how filing deadlines may apply, and help you better understand the process moving forward.
